image 246This indenture made and entered into this the fifth day of March in this
year of our Lord eighteen hundred and forty five between Henry F Birk
and Elizabeth A his wife of the County of Platte and State of Missouri
of the first part and Neumen Hamber of the County and State
aforesaid of the second part witnesseth. That the said party of the first
part for and in consideration of the sum of sixteen hundred dollars
to them in hand paid, the receipt whereof is hereby acknowledged have
granted bargained and sold and by these presents doth give grant
bargain sell convey and confirm unto the said party of the second
part and to his heirs and assigns forever a certain tract parcel or
piece of land situate lying and being in the County of Platte and
state aforesaid it being designated and known as the North East
quarter of section no. twenty seven of Township fifty four of
Range thirty six containing by estimation one hundred and sixty
acres more or less together with all and singular the appur
tenances and herewith warrents thereunto belonging or in anywise appertenances
to have and to hold unto the said party of the second part and to his heirs and
assigns forever and the said party of the first part for themselves their heirs exec
utors and administrators agree to and with the said party of the second part
his heirs executors and administrators that the before described to with parcel
or piece of land and bargained premises they will warrant and forever
defend against the claim or claims of all and any person or persons
whomsoever in witness whereof the said party of the first part have
hereunto set their hands and seals this the day and year first above written

Be it remembered that on this the __ day of March eighteen
hundred and forty five before the undersigned justice of the peace person
ally appeared Henry F Birk and Elizabeth his wife both personally
known to me to be the persons whose names are subscribed to the foregoing
instrument of writing as having executed the same and severally ac
knowledge the same to be their act and deed done for the purposes
therein set forth she the said Elizabeth A being by me first made
acquainted with the contents thereof and by she examined sep
arate and apart from her husband whether she executed the said
instrument of writing and relinquished her dower to the lands and
tenements therein mentioned freely voluntarily and without compulsion
or under influence of her said husband acknowledged and declared
that she executed the said deed and relinquishes her dower to the
lands and tenemants therein mentioned freely voluntarily and without
compulsion of her said husband or under influence given un
der my hand this the day and year aforesaid
