Adam Broils Deed – Randolph County, North Carolina (1787)

While digging through my BRILES folder, I uncovered a photocopy and handwritten notes for a 1787 Randolph County, North Carolina deed in which Adam Broils sold land to Benjamin Rush. According to my notes, this land had been willed to Adam by Conrad Broiles, making the deed an important link between two generations of the Broiles family.

Using FamilySearch’s Full Text Search, I located this deed online on film 7560686. The images from this filming were usable, but the edges of the page were difficult to read in places. Fortunately, the combination of my earlier notes and a careful transcription allowed me to “fill in the blanks” and reconstruct the full deed text with confidence.

Curious about the image quality, I searched the FamilySearch Catalog and discovered that this volume had been filmed more than once. The images I initially viewed came from a later filming, but to my surprise, the earlier filming produced a clearer image of the original record. This was a good reminder that when multiple filmings exist, it’s worth checking them all—sometimes the older images are actually better.

Transcription

This Indenture made this 3d day October
the year of our Lord one Thousand Seven hundred & Eighty seven
between Adam Broiles of the County of Randolph & State of No Carolina
the one part & Benjamin Rush of the County & State aforesaid of the
other part Witnesseth that for & in consideration of the sum of Seventy
pounds Current Money to him in hand paid by the said Benjamin
Rush the receipt whereof the said Adam Broiles doth hereby acknowledge
hath given, granted, bargained & sold, aliened, enfeoffed & conferred
and by these presents doth give, grant, bargain, sell, alien, enfeoff
& confirm unto the said Benjamin Rush his heirs & assigns forever
all that tract or parcel of land situate lying & being in the
County of Randolph & on the waters of Caraway beginning at a
post oak on the old line & running thence west crossing the creek
[110 poles] to a stake in the old line, thence north 160 poles to a stake
at old corner, thence east crossing the creek 110 poles to a stake on old
corner, thence south on the old line to the beginning, containing
110 acres of land, it being part of a tract of land formerly granted
to Conrad Broiles by Henry E. H. Culloh & by the said Conrad
Broiles willed to the said Adam Broiles & by the said Adam Broiles
to the said Benjamin Rush, with all woods, waters, mines, minerals,
hereditaments and appurtenances to the said land belonging or
appertaining, to have and to hold to the said Benjamin Rush his heirs
& assigns forever, well & clear from all incumbrance whatsoever,
the sum of money yearly or otherwise as our General Assembly hereafter
from time to time may direct only excepted.

And the said Adam Broiles & Elizabeth his wife for themselves and
their heirs, executors & administrators do covenant & agree to and
with the said Benjamin Rush his heirs & assigns that they or either
of them shall at any time hereafter execute any other conveyance or
conveyances which the said Benjamin Rush or his attorney learned in
the law may direct for the more full & final assurance of the above
described land & premises, provided always that such further
conveyances shall be at the cost of the said Benjamin Rush & contain
no other warranty than is herein contained.

In witness whereof they have hereunto set their hands & seals
the day & year above written.

Court Entry

State of North Carolina ⎬ Randolph County ⎬ August Term 1789
The execution of the foregoing deed of conveyance was duly proved in
open court by William Boyd & ordered to be registered.

This 1787 deed not only documents the transfer of land from Adam Broils to Benjamin Rush, but also helps bridge generations by confirming that the property originated with Conrad Broiles and passed to Adam by will. Beyond the family connection, this find is a good reminder of the value of revisiting records in different formats—examining multiple filmings can reveal clearer images and more complete details. Each deed like this adds another solid piece to the Briles puzzle and moves the story of this Randolph County family forward.
